made between John Higginson of Johnstown, Co Dublin, Gent
and James Cunningham of the City of Dublin, Merchant,
reciting that Robert Mason Esq of Dublin, by a lease dated
2nd June 1701, did demise unto the said John Higginson a
piece of ground situate on the east side of Skinners Alley
near the New Market in the Liberty of St Thomas Court and
Donore in the county of Dublin. (41 feet to the front X 118
feet in breadth backwards.) In the said deed was a clause
for renewal reciting that Henry Percy of the City of Dublin
by his indenture of lease bearing date 13 October 1705 did
demise unto John Higginson a piece of ground fronting the
High Way leading from Cork Bridge to Dolphins Barn, being
part of the field lately in the possession of John Hassett,
Brewer (36'feet to the front & rear and from front to rear
102 feet) to be held by Higginson, his heirs & assigns from
29th September during the natural lives of Henry Percy,
Robert Percy and John WARD* on payment of 36 shillings per
annum from Higginson. Also reciting that Henry SMITH of
Tripolo in the Liberty of St Thomas Court by his lease dated
23rd December 1700 demise unto Higginson a piece of ground
in Earl Street in the same Liberty, as the same was then
'inclosed with stone walls' containing 20 feet to the front
of the street and assigned for 21 years from 24th June 1700
for the yearly rent of one peppercorn, as likewise reciting
that Joseph Kane of the Upper Comb (Coombe), Clothier, by
his indenture of lease dated 2nd February 1700 did demise to
Higginson one piece of ground in Skinners Alley (32' to the

43-125-27611 Memorial of an indented deed of bargain and
sale dated 5 Sep 1724 and made bet William Wall, City of
Dublin Gent and Thomas Higginson of the same city Gent
whereas the said William Wall in consideration of £28
sterling to him paid by Thomas Higginson demised for one
whole year part of the lands of Ballyronan situate in the
Barony of Newcastle, Co Wicklow, 50 acres together with all
the rights members and appurtenances at a yearly rent of
£14-3-3 sterling per year and a year's rent as a fine for
renewal for every life - Fox is mentioned as another tenant
with 11 years to run until his lease expires. Witts: John

48-160-31204 THE Monaghan connection! Charles Higginson
married Martha Mansfield IN Monaghan in 1872 and Mary
Charlotte Warner was a witness - see marriage certificate in
envelope marked CERTIFICATES. The Earl of Mansfield,
domiciled in county Donegal where there was also a titled
Hayes family (baronets), also held lands in Monaghan from
the 1600s. There had also been a Warner connection in
Monaghan going very far back. The Mansfield 1 Warner
connections were also in Cork. )

Date the nineteenth and twentieth days of August one
thousand seven hundred and twenty four the Release being an
Indenture Tripartite made between William Hamilton of
Blaneysbridge in the County of Monaghan Esquire and James
Hamilton of Cavan in the said county Gentleman Son and Heire
apparent of the said William Hamilton and Susanna Hamilton
als Ellis wife of the said James Hamilton of the first part
Anthony Obbins of Portadowne in the County of Armagh Esquire
and Valentine Jones of Lisburne in the County of Antrim
Esquire of the second part and Edward Higginson of
Magheragaie in the said County of Antrim Gentleman of the
third part Reciting that in pursuance of a Marriage had and
solemnized between the said James and Susanna and of
Marriage Articles made and duly perfected before the said
Marriage bearing Date the twenty eighth day of May one
thousand seven hundred and twenty four between the said
William Hamilton James Hamilton and Edward Higginson that in
consideration of the said Marriage and Marriage Articles and
the other considerations in the said Indenture of Release
mentioned that they the said William Hamilton and James
Hamilton did release and convey to the said Anthony Obbins

hold the same to them their heirs and the Survivor and the
heirs of such survivor for ever in as full and ample manner
as the said William and James Hamilton or either of them or
either of their Heirs could or might have done in case these
presents had not been made in trust nevertheless to the use
of said James Hamilton during his natural life with
Impeachment of Waste in case he shall Cutt downe or Destroy
any of the woods or ornamental Trees now planted or growing
or hereafter to be planted on the said Lands without Special
Licence first had in writing under the hands seals of said
Anthony Obbins and Valentine Jones or the Survivor or the
Heirs of the Survivor and from and after the Determinacon of
that Estate to the use of said Edward Higginson to preserve
Contingent Remainders and after the Death of said James
Hamilton to the use of said Susanna to have and receive out
the Rent Issues and Profits thereof a yearly rent charge of
sixty pounds in case the said James Hamilton should at the
time of his Death leave Issue Male behind him during the
Life of such Issue Male to be paid by half yearly payments
with power to Distraine for the same and from and after the
respective Deaths of said James and Susanna and his Issue
Male and for Default of such Issue to every other son and
son of said James and Susanna and their Issue Male with due
regard to the Seniority of such sons and their Issue Male
and for Default of such Issue in case said James should Dye
without leaving Issue Male behind him or in case he should
leave Issue Male at his Death and such Issue Male should Dye
without leaving Issue Male behind him and in case there
shall be living at the time of the Death of said James one
or more Daughter or Daughters of said James by said Susanna
then to the use and behoose of such Daughter and Daughters
and their Issue Male Lawfully to be begotten that is to say
if but one Daughter or Daughters in the Life time of said
Susanna become Entitled to the said Lands and Premises by
virtue of these presents then the said Susanna shall have
and receive out of the Rents and Profits of said Lands and
Premises every year during the Life of said Daughter or
Daughters in Case the said Susanna shall so long live The
yearly rent charge of eighty pounds to be yearly paid and
received in manner as the aforesaid rent charge is to be
received and paid and in Default of such Issue Male or
Female of said James on the body of said Susanna to the use
of said Susanna during her Life so that she shall not Cutt
Down or Destroy any of the Woods or ornamental Trees that
shall be then standing or growing on the Lands or any part
of them and from and after the Death of said Susanna and in
Default of her Issue Male or Female by said James Hamilton's
right heirs for ever and the said Indenture or Release
further recites that by the said Marriage Articles the said
James Hamilton did consent and agree that all and every the
Houses and Lands and Tenants hereafter mentioned (viz) a
Large Brick House in the possession of William Pringle and
others in the High Street of Belfast and several other
Houses on a plot of ground in Church Lane containing in
Length six score and six foot and in breadth twenty two feet
abutting on the Church Yard of Belfast aforesaid which the
said Susanna was possessed of before her marriage with the
said James by virtue of an Indenture of Lease bearing Date
the first day of October one thousand and seven hundred
sixteen made by the Earle of Donegall for the said Susanna
for the Term of Forty one years from the Date thereof at and
under the rent of seven pounds one shilling sterling for and
during the Life of William Arne Thompson and for the
remainder of the said Term of fifteen pounds sterling of and
as to of certain Lands in Brookhill in the County of Antrim
by virtue of a Lease bearing date the twentieth day of
September one thousand seven hundred and sixteen and made by
said John Rawdon (Baronet) lately deceased to the said
Susanna for twenty one years from the first of May one
thousand seven hundred and sixteen at the rent of ten pounds
nineteen shillings and three pence of which she was all
possessed before her Marriage with the said James should
remain and continue in the same ?plight? and condition so
that the said Susanna should and might receive and take
during her Coverture all the rents Issues and Profits of the
same to her own separate use and behoose, without any
account at any time to be given to the said James Hamilton
and Freed and Discharged from all manner of Debts
Incumbrances now Due or hereafter to be made or become due
by him the said James Hamilton the said Indenture further
witnesseth that for the Considerations aforesaid and in
order that she the said Susanna may have the full benefit
and advantage of said Leases in case she survive him the
said James Hamilton over and above all Joynture Dower third
7thirds? and Demands whatsoever which she may be Intitled
unto out of the Estate real or personal ( ? ) all that
said James Hamilton shall Dye Seized or possessed of he the
said James and Susanna did by the said Indenture Grant and
Assign over to the said Anthony Obbins and Valentine Jones
all and every the said Houses and Tenements in Belfast
together with the said Indenture of Lease as also the Said
Lands of Brookhill together with the said Indenture of Lease
to hold the same to them and the Survivor of them their
Executors and Administrators and the Executors and
Administrators of the Survivor of them for and During the
remainder of the Term and Terms of years mentioned in the
said Respective Leases yet to come and unexpired in as full
and ample manner as the said Susanna held the same subject
to the rent and covenants therein mentioned and to the uses
Intents and Purposes following and no other That is to say
that the said Susanna may receive to her own use and behoose
yearly and every year from the first day of May fast past
During her Life in Case the said Leases shall soe long
continue all the rent issues and profits thereof to the said
Anthony Obbins or Valentine Jones or the Survivor of them or
to him the said James Hamilton his Executors and
Administrators or Assigns and Discharged from all Debts and
Incumbrances of said James Hamiliton and in Case the said
Susanna shall Dye before the said Leases or either of them
shall Expire that from and Immediately after her Death to
the Intent that the said James if he survive the said Suanna
shall receive the rents and profits from all the said Leases
from the Death of said Susanna During his natural Life in
Case the said Leases shall soe long continue and from and
after said James Death the said Leases (in case the same be
their being and undetermined) shall Ensure the same Intents
uses and purposes as the said Lands of Inheritance herein
before mentioned are Limited and appointed and shall attend
the same and the said James doth covenant that in case the
said leases or either of them shall Determine before the
Death of said Susanna in case she Survive the said James
shall receive and take to her own use and behoose one third
part of the rents issues and profits of all and singular
such Houses Lands and Tenements as he the said James shall
Dye possessed of either in his own name or in the name of
any other person in trust for him over and above the
aforesaid rent charge and the rents issues and profits of
the aforesaid Leasehold Lands and that she the said Susanna
shall have full power by virtue of these Presents by any
Instruement in writing under her hand and that Duly
Perfected in Presence of three of more Credible witnesses to
charge all or any of the aforesaid Lands Tenements and
Premises any sum or sums of money not Exceeding five hundred
pounds sterling and that the said sum shall by the said
Anthony Obbins Valentine Jones and the survivor of them and
the heires Execrs and Admrs of the survivor of them be
raised out of all and singular the before mentioned Lands
Tenements and Premises by Sale Mortgage or otherwise and
shall be paid to such person or persons and by such Sales
and at such times and in such a manner as said Susanna shall
by such Instrument in writing or by her Last Will Duly
published Limitt Direct and appoint and the said William and
James Hamilton doe covenant that the said Lands soe settled
are Free and Cleare from all Debts and Incumbrances Except
the Sum of Nine Hundred Pounds and that they shall be freed
and Discharged from the same in Some reasonable time which
said Deeds of Lease and Release were duly Executed by the
same James Hamilton Susanna Hamilton and Valentine Jones in
presence of Edward Lyndon Esquire one of the Masters of His
Majesty's High Court of Chancery in Ireland and James Byrt
Late of Lisburne in the County of Antrim Gent deceased then
Clerk to the said Valentine Jones And this Memoriall signed
and sealed by the said Valentine Jones in Presence of the
said Edward Lyndon and Michael Mansfield of the City of

Higginson of Gowlyduffe Co Kildare to Simon Hammond
Bricklayer of the city of Dublin dated 25 April 1735
conveying a piece of ground on the south side of Abbey
Street, alias the Strand, bounded an the west by ground in
the possession of William Hogan, on the east by James Cook's
holding, on the south by New Strand Street and on the north
by (Upper) Abbey Street together with the dwelling house and
tenement then in the possession of Mr John Stewart together
with all the buildings on this plot of ground for a term of
200 years

Higginson to John Gallagher Richard Higginson of Carrick (on
Shannon) county Leitrim Shoemaker demised to his son-in-law
Charles Gallagher of Carrick a dwelling house and stable
which had been built by Charles Gallagher on Richard
Higginson's plot of ground in the town of Carrick, together
with the backside and part of the garden laid out for the
said house (then set by Charles Gallagher to John Moran) for
and during the natural life of the Rev Nichola Synge or Tuam
Co Galway the Hon Mary Usher, wife of John Usher then of
Carrick and Usher St George Esquire, son of the said John
Usher for the yearly rent of ten shillings and sixpence.

Dublin gentlemen. [.. east side of road to Rathfarnham adjy
tenement of Hy PAXTON grocer. Yearly rent ..]. The above is
correct and not missing any vital info. Here is Patrick
street again ? The Patrick CULLODEN of Belfast was from
Patrick Street ?

Lucy Skelton and Elizabeth Moore at the yearly rent of £32
Reciting that Thomas Higginson is dead but before his death
made his will and devised unto his wife Mary Higginson
otherwise Colley, now Mary Bennett, his leases of Tomsilia,
Ballyboymore and Moneyhere during her life and no longer and
direct that at her decease the said leases should be sold or
set to the best advantage and the profits arising therefrom
to be equally divided among his children viz Thomas

Thomas transferred to Valentine Gill two thirds and

Boyse) of the Parish of Derrighy, Linen Draper and George
Higginson, son of William Higginson of the Parish of
Ballinderry, Co Antrim, Yeoman and Margaret Higginson
daughter of the said James and the survivor of them

respectively from James Higginson and John Hinchcliff of
Cork city to Robert Johnson for the property in Hammond's
Marsh. This could be the same James Higginson who went to
America in 1768. year probably 1761-1771
1771 266 396 [376] 171544 Memorial of Indeture of Mortgage
Dated 14th June 1768 Between: JAMES HIGGINSON, City of Cork,
Linen Draper of the first part John Hinchcliff, City of
Cork, gentleman of the second part Robert Johnson, City of
Limerick, merchant of the third part. Reciting: That in
consideration of the sum of £500 paid by Robert Johnson to
JAMES HIGGINSON and John Hinchcliff, HIGGINSON and
Hinchcliff released a parcel of land commonly called
Harman's Marsh being part and parcel of the Deal Yard of
Francis Penrose, merchant, bounded on the East by the public
Quay facing the town wall and containing on the west 98 feet
on the north with the public quay and Sepitt's Buildings
..... in the parish of St. Peter to hold by said Robert
Johnson until the redemption of the said mortgage.
1761-1771 266 396 [376] 171545 Memorial of Indenture of
Lease Dated 10th June 1768 Between: JAMES HIGGINSON, City of
Cork, Linen Draper of the first part Francis Penrose,
Limerick City, merchant and John Hinchcliff, Limerick City,
merchant of the second part Reciting: Release for certain
considerations land at Harman's Marsh the land that had been
recently demised to HIGGINSON by PENROSE. The description
of the location is as above. Interestingly this memorial
mentions two houses, partly built, by JAMES HIGGINSON. To
hold for 898 years at the yearly rent of £49 per annum. I am
also wondering if he is a relation ?

Peter's Parish, Cork city - ground and houses. Indented deed
of mortgage dated the 11th day of March 1771 and made
between James Higginson of the City of Cork Linen Draper of
the one part and George Rallans of the north suburbs of the
said City Linen Draper of the other part, reciting that
whereas Francis Penrose of said City Merchant by indenture
of lease dated the 17th day of November 1767, for the
consideration therein mentioned did demise and sett unto the
said James Higginson all that and those a piece or plot of
ground on the northwest marsh of the City of Cork commonly
called Hammonds Marsh being part and parcel of ye Dealyard
of the said Francis Penrose bounding on the East with the
Pub(lick?) Quay facing the Town Wall and containing in front
to the East ninety-eight feet on the North with the Pub Quay
opposite Lipits Buildings and containing in front to the
North ninety feet on the West with a Lane or Passage eight
feet wide dividing the Premises? Thereby demised from the
other Premises? of ye said Francis Penrose and containing in
front to the West Sixty Four feet and on the South with
another Lane of Passage Eight feet wide also dividing the
Premises thereby demised from the Dwelling House of the said
Francis Penrose and ranging on the South from the North
front to the break Forty-one feet Six inches and (torn) -
ping from thence Fifty-six feet . . . This Memorial was
signed by Thomas Beamish (the Mayor?) and John Herne, both
of the City of Cork, Gentlemen.

matter of the lands in Monemuch was cleared and confirm that
Richard Higginson of Dublin and Joseph Higginson of
Monemuch, Co Kilkenny were the two sons of Richard Higginson
of Monemuch, Co Kilkenny then deceased. The lands were
released to Richard Philips of Philipsburg in the Queen's
County

LDS 531679 306 244 203207 An explanation Dated 9th May
1768 this is a marriage agreement between Job Hall of
Ballymachree, Co Wexford a farmer and Richard Finley and
Holland Finley of Ballymenarie, Co Wexford both farmers. The
marriage is intended between Thomas Hall elder son of Job
Hall and Hester Finley, daughter of Thomas Finley of
Ballymenarie, deceased. My research shows a will of Holland

Wexford, a farmer, has land near Ballynecre in the Barony of
Gawrey (should be Gorey?) Co Wexford. The land is adjacent
to land in the possession of Daniel Hall and on the south
side of the road to Castletown. The land is being leased
under a 'lease for lives' system whereby 3 persons are named
and the lease is in existence whilst any of those named are
alive. Job Hall is leasing the land to Michael Cullidon,
therefore we know that Job Hall the elder and Michael
Cullidon are both alive on 8th May 1779.

This is another lease of land by Job Hall the Elder of Ash,
Co Wexford to Job Hall the younger of Ash, Co Wexford, a
farmer, and Michael Culliden, a butcher from Dublin. The
land is near Ballynacre Co Wexford, on the north side of the
Castletown road. This land is 'leased for lives,' but with a
renewal clause so that if a named person dies, another name
can be added for a fee. This lease was also registered on
8th May 1779, but was originally drawn up on 6th Aug 1778.
Note that one of the signatories was Mrs Elizabeth Hall of
Ash, Co Wexford. This lease is one of those mentioned in LDS

Dated 8th May 1800 and registered on the 9th May 1800, this
land lease is between Thomas Hall of Cullenbra, Co Wexford,
Nathaniel Hall of Rathmore, Co Kildare and Michael Culloden
of Mill St, Dublin a tanner. The land involved appears to be
two pieces of land, one held by Thomas and one by Nathaniel.
It shows the history of leases for these lands; 11 June 1773
Thomas Hall leased some land to Nathaniel Hall. 7 May 1789
John Alexander Guffield of Castle ?Ludan?, Co Meath leased
some land to Thomas Hall on a 'lease for lives' naming 3
lives; Thomas Hall eldest son of Thomas Hall aged about 21,
Joseph Hall 2nd son about 12 years and Daniel Hall 3rd son
about 9 years. Now Thomas and Nathaniel are leasing their
lands to Michael, the lands currently rented by Patrick
Corcoran, Aran Abraham and William McKay. (My comment. This
document shows the classic dividing up of land into smaller
and smaller lots. Although this land was leased to Thomas &
Nathaniel, they had sub-divided it and rented it out to 3
people! The unusual aspect is that it the two leases are now
being brought together as one lot to Michael.)

administrators of the estate of John Smith of Back Lane,
Dublin a leather seller, who has gone bankrupt, and Nicholas
Dowling of Marys Lane, Dublin a baker. John Smith had leased
these premises from Elizabeth Harris (widow of William
Harris) of Charlemount St, Dublin on 24 Dec 1796. The leased
premises at that time were occupied by Francis Wall. The
premises were at 17 Mary's Lane, Dublin (in the lordship of
St Marys Abbey). Jeremiah turns out to be Jemima later in
the document, but the writer had a lot of trouble with the
name! As administrators Jemima and Patrick are re-leasing
the property to Nicholas Dowling. One of the signatories to
the lease was Daniel Hall, a clerk to Jemima.

and the capital was protected against JAMES ROWAN in case he
should become insolvent. After MARY and JAMES' decease the
capital was to be divided equally amongst their children and
that James Rowan would bequeath voluntarily in his will to
his wife her jewels and wearing parapharnalia [sic]. This
really is the early 19th century equivalent of a prenup. I
have now found James's son Andrew and his son Culloden ROWAN
in the British Censuses.

completed 535468 424344. It shows a possible marriage to
take place between George Southerin (?Southern) and Jemima
Culloden, daughter of Jemima Culloden and Michael Culloden.
She is being given her part of the estate of Michael, all of
the others seem to have got the same when they married,
except for Dorothea who claimed, and got, more! George seems
to have been living around the Bray area of Co Wicklow, from
what I have read about Bray, this seems to have been quite
an affluent area. Tithe Applotment books may still show him
in the same area, newspapers of the area may have covered
the marriage, there may be gravestones to check out as well.
Jemima the elder is still a widow at this stage (1810),
although this deed does mention Joseph Beddy as a witness,
so he is somewhere around! That pins down a marriage to
Joseph between 1810 and 1813.

September 1815. It would appear that HENRY HIGGINSON was
one of the trustees for Cornwallis Eustace and this memorial
refers to 195. 3. 22 acres of land at Robertstown, Co.
Kildare, held in trust by HENRY HIGGINSON and now released.
This memorial does not make a great deal of sense and may
have portions not transcribed by the clerk from the
original!

the fine sum of 100 guineas and the yearly rent of £125

Reciting:
Reciting deed of lease made by David La Touche in 1784 [see
above] same description of the house as mentioned in above
deed. It would appear that the premises at 15 Eustace
Street came into HENRY HIGGINSON'S possession in 1808. The
dwelling was free from incumberances and recites a memorial
of indenture became vested in HENRY HIGGINSON. On 18th June
1816 the property in consideration of £700 the property
became vested in JOHN HALL CULLODEN. A commission of
bankruptcy was awarded under the Great Seal of Ireland
against HENRY HIGGINSON on 22nd June 1816 and on that date
he was declared a bankrupt and his estate assigned to
Nicholas Mahon. In the High Court of Chancery, 13th July
1816 Mahon was assigned the major portion of HENRY
HIGGINSON'S goods, estates and effects for the benefit of
HIGGINSON'S creditors and in the consideration of £113. 15s.
JOHN HALL CULLODEN released 15 Eustace Street to John Dignan
Williams.
So we know that Henry died after December 1817. One of
Henry's children, my Charles HIGGINSON, was born abt 1811.

That be virtue of a lease of 1779 Michael Culloden leased to
Christopher Fox a premises at Slaughter Lane, victualler,
and he had lately erected a house known as the Butcher's
Arms. Recites that this was left in the administered good
and chattels to Jemima and his 10 children, one of who was
Dorothia who had lately attained the age of 21 years and
that Dorethia and some of the other children had recently
lodged a bill in the High Court of Chancery for an account
and distribution of Michael Culloden's goods and chattels.
This Joseph and Jemima have duly answered and for the
purposes of an amincable and just settlement Dorethia was
granted the interests and rent charges on property in New
Row and that Dorethia had accepted this as full discharge of

This document shows that Jemima Culloden has remarried by
1813 to Joseph Beddy of Rathdownes, Co Wicklow. She is the
executor of her late husband (Michael Culloden) who died
without leaving a will. Dorothea Culloden of Dublin is one
of 10 children of Michael and Jemima Culloden and in 1813
has reached her majority (21). She is not happy with the
amount offered from the estate and has a court case against
Jemima pending in the Irish High Court of Chancery. Some of
the other children have joined her in this action. There may
be Chancery Court documents of this case. In order to
appease Dorothea, Joseph and Jemima have offered her some of
the rent money out of a property in (Pat) Patrick Street and
have offered her the house etc. in New Row. Hence this lease
with the history of other leases. One would assume there was
a delay in registering this deed as the first date mentioned
is 1813, but the deed was not lodged until 6th April 1814.
Did they have to wait for a court case or for all the
children concerned to agree? The document lists a number of
leases for the same land in New Row, Dublin; 5 Jan 1799

Reciting:
Reciting deed of lease made by David La Touche in 1784 [see
above] same description of the house as mentioned in above
deed. It would appear that the premises at 15 Eustace
Street came into HENRY HIGGINSON'S possession in 1808. The
dwelling was free from incumberances and recites a memorial
of indenture became vested in HENRY HIGGINSON. On 18th June
1816 the property in consideration of £700 the property
became vested in JOHN HALL CULLODEN. A commission of
bankruptcy was awarded under the Great Seal of Ireland
against HENRY HIGGINSON on 22nd June 1816 and on that date
he was declared a bankrupt and his estate assigned to
Nicholas Mahon. In the High Court of Chancery, 13th July
1816 Mahon was assigned the major portion of HENRY
HIGGINSON'S goods, estates and effects for the benefit of
HIGGINSON'S creditors and in the consideration of £113. 15s.
JOHN HALL CULLODEN released 15 Eustace Street to John Dignan
Williams.
So we know that Henry died after December 1817. One of
Henry's children, my Charles HIGGINSON, was born abt 1811.
