In the Name of God Amen I James Fitzpatrick of Gartnamona in 
the County of Galway being of sound mind and memory though 
weak of body and wishing to settle all my temporal and 
worldly affairs and concerns do make and publish this my 
last Will and Testament (annulling cancelling and revoking 
all or any others that I may have made heretofore) in the 
manner following Whereas I am seized in fee of all that and 
those the lands of Seppy Park Cullogh Bohuna East Killoe 
upper west Killoe lower west Killoe Sheanvoe knocks and 
mountain farm situate lying and being in the  County of 
Galway and in the Barony of Maquillan I do devise will and 
bequeath the above said lands with all the various 
subdenominations rights appurtenances and privileges as now 
enjoyed by me unto Robt Barry of Woodvill Esqr and Thomas 
Mahon of Belville Esqr both in the County of Galway In Trust 
however for the following uses and purposes that is to say I 
do will and bequeath the lands of Bohuna with all their 
various subdenominations rights and privileges (as held by 
Martin Marvis Esqr) during her natural life unto Anne 
Fitzpatrick otherwise Burke my beloved wife as a jointure 
and provision for her and after her decease I do will and 
bequeath same said lands with their various subdenominations 
rights appurtenances and privileges unto Patrick Blake of 
Tully Esqr during the term of his natural life and after his 
decease to his male issue the elder having the preference 
and so on to the younger and in case of failure of male 
issue to the said Patrick Blake I will and bequeath the same 
lands to my nephew James Browne and limitations as to the 
said Patrick Blake and on to the other nephews in succession 
the elder having the preference and so on to the youngest 
with the alike limitations and privileges as to the 
aforesaid Patrick Blake and in case of failure of male issue 
to all the same said lands with their various 
subdenominations rights appurtenances and privileges unto in 
remainder unto James Fitzpatrick of the Town of Cove and his 
heirs for ever I do further will and bequeath all that and 
those the lands of Seppy Cullogh and Sleanvoe with all their 
various subdenominations appurtenances rights and privileges 
(subject to an annuity of fivety pounds a year which I will 
and bequeath unto my Mother in law Marcella Burke during her 
life) unto my nephew James Browne during the term of his 
natural life and after his decease to his male issue with 
preference to the eldest son and so on to the youngest and 
in case of failure of male issue to the said James Browne 
the same unto my other nephew in succession with preference 
to the elder with the like limitations and privileges as to 
the aforesaid James Browne and in case of failure of male 
issue to all or all dying before he reaches the age of 
twenty one years I will and bequeath the same unto James 
Fitzpatrick of the Town of Cove and his heirs for ever I 
further will and bequeath the lands of Park subject to an 
annuity of One hundred pounds a year unto my beloved mother 
Hellen Fitzpatrick during her life in addition to her 
jointure East Kilvoe upper west kilvoe lower west Kilvoe 
knocks and Mountain farm with all their various 
subdenominations rights appurtenances and privileges subject 
however to the Payment of all my Bond debt and judgments 
effecting all my aforesaid Estates also to the payment of an 
annuity of one hundred pounds a year to my beloved wife Anne 
Fitzpatrick otherwise Burke during her life and a further 
annuity of fifty pounds of year to James Blake Junor Lodge 
during his life to the aforementioned Patrick Blake of Tully 
Esqr during his natural life and after decease of his male 
issue in succession with preference to the eldest and so on 
to the youngest and in case of failure of  issue male to the 
said Patrick Blake I will and bequeath the same unto James 
Browne (my nephew) and to my nephew in succession for the 
eldest to the youngest with the alike limitations and 
privileges the aforementioned Patick and in case of failure 
of male issue to all I give and bequeath the same lands with 
all their rights and privileges to James Fitzpatrick of the 
Town of Cove and his heirs for ever I further will and 
bequeath unto my beloved wife Anne Fitzpatrick otherwise 
Burke during the term of her natural life all the leasehold 
property held by me in the West liberties of Town of Galway 
(under the representatives of the late Miss Burke) and after 
her decease I will and bequeath the same to descent in the 
same and with the alike limitations and remainders of the 
lands of Bohuna I further will and bequeath unto my Mother 
Hellen Fitzpatrick during her natural life all my leasehold 
property  in the East liberties and Town of Galway and held 
by me under the Trustees of the Will of Erasmus Smyth and 
held under me by Charles Browne Esqr Bridget Burke and the 
Revd Mark Fyn and after her decease I will and bequeath the 
same to descent in the same and with the alike limitations 
and remainders as the lands of Bohuna I further will & 
bequeath and order the following sums to be paid out of my 
Personal assetts within twelve months after my decease that 
is to say I will and bequeath the sum of five hundred pounds 
to my dear Cousin Jane Blake of Tully the sum of Two hundred 
pounds to my friend Lancelott Maher of the Town of Galway as 
a token of my regard for him and the sum of fivety pounds to 
Harriett Burke as a mark of my Gratitude to her for her 
kindness in my illness I further will and order that all my 
personal debts be discharged (as soon as possible after my 
decease) out of my personal assets I also will and appoint 
my beloved wife Anne Fitzpatrick otherwise Burke sole heir 
and residuary legatee(after the payment of my legacies & 
debts) to all my property or any kind of property (not 
particularly specified by me and my will)  that I may die 
possessed of at the time of my decease and I do appoint  
Anne Fitzpatrick otherwise Burke together with the 
Honourable and Revd Charles Lepore Trench and James O'Hara 
junior of West Lodge Esqr Executors of this my last Will and 
Testament Signed sealed delivered and published by me Jas 
Fitzpatrick in Presence of Thos Cahalan _Dennis Calahan _ 
Mary White dated the thirteenth day of January one thousand 
eight hundred and twenty eight 
(Codicil dated 14 January 1848 divides household furniture 
between mother and wife Witness Lambert Mahon)
