COUNTY DOWN WILL - MARY KENNEDY BORN AS FLETCHER, OCTOBER 23, 1823

In the Name of God Amen I Mary Kennedy otherwise Fletcher of
Maryfield in the County of Down Widow of Henry Kennedy late
of Maryfield aforesaid Esquire do make and publish this my
last Will and Testament in manner and form following whereas
by Indenture bearing date the thirty first day of August one
thousand eight hundred and one made between Edward Fletcher
then of Lisburn in the County of Antrim but now of
Devonshire Square in the City of London Esquire of the first
part me the said Mary Kennedy by my then name and escription
Mary Fletcher of Lisburn in the County of Antrim Spinster
and Sister of the said Edward Fletcher of the second part
the Reverend Philip Fletcher of Lisburn aforesaid and James
Alexander of Calcutta in the East Indies Esquire of the
third part after writing as therein is recited the said
Edward Fletcher did give grant bargain sell assign transfer
and make  over unto the said Philip Fletcher and James
Alexander the thereinbefore mentioned Decennial Loan
Obligation of the Government of Bengal in the East Indies
number six hundred and thirty two of the year one
thousand seven hundred and ninety nine one thousand eight
hundred for sixteen thousand …..rupees making the sum of two
thousand pounds British money To hold the same and all sum
and sums of money then due or thereafter to accrue or become
due or payable thereon unto the said Philip Fletcher
and James Alexander and the Survivor of them and the Heirs
and assigns of such Survivor upon the trusts therein
mentioned and among others and amongst other upon trust that
the said Philip Fletcher and James Alexander and the
Survivor of them and the Heirs and assigns of such Survivor
should yearly and every year during the natural life of me
the said Mary Kennedy then Mary Fletcher pay the yearly
interest or produce of the Decennial ten per Cent Loan
Obligation unto me the said Mary Kennedy then Mary Fletcher
in manner therein mentioned and in case I the said Mary
Kennedy then Mary Fletcher should happen to die unmarried or
married die without issue then upon trust that the said
Philip Fletcher and James Alexander and the Survivor of them
and the Heirs and assigns of such Survivor shall pay and
dispose of the said trust money or sum of two thousand
pounds and all interest due thereon In trust for and to the
sole use of such person or persons and for such use and
purposes and in such parts and proportions manner and form
with or without powers of reservation as I the said Mary
Kennedy then Mary Fletcher should from time to time whether
sole or married by any writing or writings under
my hand and seal attested by two or more credible witnesses
or by my last Will and Testament in writing or any writing
purporting to be my last Will and Testament to be by me
signed sealed and published in the presence of and
attested by the two credible persons who have hereunto
subscribed their names as witnesses direct limit give and
appoint the said trust money or sum of two thousand pounds
and all interest that shall be due thereon at the time of my
death unto my brother the said Edward Fletcher To hold to
the said Edward Fletcher his Executors Administrators and
assigns for ever And I do direct authorise and empower the
said Philip Fletcher and James Alexander and the Survivor of
them and the Heirs and assigns of such Survivor to pay the
said trust money or sum of two thousand pounds or to
assign transfer and make over the securities for the same
unto the said Edward Fletcher his Executors Administrators
and assigns I leave and bequeath to John Kennedy Esquire the
brother of my late husband Henry Kennedy and to Sarah
Simpson and Mary Kennedy the Sisters of my late Husband
the sum of twenty guineas each for the purpose of buying
mourning rings and it is my wish and I hereby request that
part of my late husband’s and my own hair should be entwined
in each of the said rings and I leave and bequeath to the
said John Kennedy during his life my said Husband’s gold
watch chain and seals and after the decease of to the said
John Kennedy I leave and bequeath the said Watch chain and
seals to my nephew John Kennedy the son of my late brother
in law William Kennedy Esquire deceased and I also leave and
bequeath to my said nephew John Kennedy the card box which
his Father sent to me as a present from India I leave and
bequeath to the poor of the Parish of Holywood a sum of
twenty pounds to be added to the sum bequeathed by my
said late Husband to the Poor of the said Parish and to be
applied and disposed of for the benefit of the Poor of said
Parish in the same manner as directed by my late Husband
with regard to the sum so bequeathed by him And as to all
the Rest Residue and Remainder of the property of whatsoever
nature kind or description I may die seized possessed of or
entitled to whether real freehold or personal in reversion
remainder or expectancy I give leave devise and dispose of
the same unto my brother the said Edward Fletcher To hold
unto the said Edward Fletcher his Executors Administrators
and assigns for ever and I do hereby nominate constitute and
appoint my brother the said Edward Fletcher and Henry orcher
of the said City of London Esq MP Executors of this my last
will and Testament and hereby revoke all other Will or Wills
Codicil or Codicils by me at any time heretofore made In
testimony whereof I have to this my last will and Testament
and to two others parts thereof set my hand and seal this
twenty third day of October in the year of our Lord one
thousand eight hundred and twenty three Mary Kennedy
