Charles Haines of Mallow
Will written 17 June 1825
Death occurred 6 February 1831
"In the name of God Amen. I Charles Haines Sen the town of
Mallow in the County of Cork being of sound and disposing
mind and understanding, thanks be to Almighty God, doth make
this my last will and testament revoking and hereby anulling
all former wills and testaments writings whatsoever made by
same and declaring this to be my only last will and
testament.
First I direct my executors herein after named to pay off my
lawful debts of any description whatsoever and soon as
conveniently can be after my decease and the same to be paid
out of my assets and the rents arising out my yearly
property exclusive and without encroaching on any part of
the debts due for an account of the portion buildings or
anything (next word unclear) except what I shall hereinafter
particularly describe and encumber (next word unclear).
Whereas I have settled on my eldest son Thomas on his
marriage with wife Nason by a lease to him made of that part
of the lands of Woodfort. This lately tenanted by Joseph and
Edward Berry, and also by a lease to him made of different
parts and denominations of the lands of Upper Gurtmore
(Clonmeen parish?), the same being the pastures or part of
any property which I intend to leave and bequeath to him at
my death and having settled the same on him and aforesaid by
leases thereof on his marriage. I leave and bequeath to him
my said son Thomas Haines the sum of ten pounds to buy
mourning.
I leave and bequeath to my second son Humphrey Haines of the
City of Cork Apothecary my interests in the lands of
Ballygarrane let by me to Mr.Arthur Hartland, I also leave
and bequeath to my said son Humphrey all my Right and title
and interest in that part of the lands of Monkstown
adjoining the town of Passage which I hold under a lease of
three lives renewable for ever with all the profits and
issues thereof, he my said son Humphey paying to my
executors the sum of three hundred pounds, which sum my
executors are to apply to the paying of my debts.
I leave and bequeath to my third son Charles Haines of
Mallow Junior my interest in the farm of Twopothouse which I
hold under a lease forever from Michael Robert Westrupp and
Henry Bryan Westrupp of the City of Cork Esquires he my said
son Charle Haines by paying unto my executors the sum of one
hundred and fifty pounds to be applied as aforesaid to the
payments of any debts.
I leave and bequeath to my fourth son Homan Haines of (next
word unclear) all my rights and titles and interests in the
lands of Upper Gortmore (Clonmeen?) in the County of Cork
and his paying the heads rents payable thereabouts and at
all times the Lord Viscount Lismore and his making good all
my leases and agreements with the tenants and performing all
the covenants which I am bound (next word unclear)
performance he my said son Homan paying the executors the
sum of three hundred pounds to be applied by (next word
unclear) aforesaid to the payments of my debts. I also leave
and bequeath to my said son Homan Haines the fields in Fair
Lane which I hold under lease made by the late John
Longfield.
I leave and bequeath to my eldest daughter Elizabeth Roche
otherwise Haines any interest in that part of Belview which
I purchased from the late Thomas Roche her husband and now
tenanted by Maurice O'Connell carpenter. I also leave and
bequeath to my said daughter Elizabeth my interests in the
lands of Gurrane (Clonmeen?) near the town of Kanturk, she
my said daughter is to receive the clear issues and profits
of the said lands as here bequeathed her from time to time
on her receipts under her hand only and not otherwise and
that it should and may be lawful to and from my said
daughter Elizabeth and I do hereby impower her by this last
will and testament or any testamentray writings to be by
her executed, to leave or dispose of the said several
premises to any or some of her children in such manner or
such share or proportions equal or unequal as she shall
think fit, and shall thereby give limit or appoint the same.
I leave and bequeath to my youngest daughter Dora Haines
otherwise Rice my interest in Shoulders Lane which I hold
under a lease made (next word unclear) by the late Denham
Jephson Esq on making good any arrangements with the
tenants. I also leave and bequeath to my said daughter Dora
Haines my interest in the holding on Bridge Street which I
hold by lease from T.McCarty. I also leave and bequeath to
my said daughter Dora my interest in the lands of Bally
(next word unclear) which I hold from John Longfield Esq she
my said daughter is to receive the clear yearly rents and
profits to be from time to time paid out of all the said
lands and tenements here bequeathed her on her receipts
under her hand only and not otherwise any will and interest
in that same shall not in any wise be subject to the
engagements control or interferance of her present husband
or any husband whom she may hereafter take and it shall and
may be lawful for my said daughter and I hereby impower her
notwithstanding coverture by her last will and testament or
any testamentary writing to be by her duly executed to give
leave to dispose of the said house and premises hereby
bequeathed her to any one or more of her children in such
manner or in such shares or proportions equal or unequal as
she the said Dora shall think fit and for want of such will
or testamentary writings being by her made to be left in
such shares and proportions as my executors hereinafter
named shall by any deed or deeds direct limit or appoint
between her children share and share alike.
I leave and bequeath to my grand daughter Ellen Roche the
sum of fifty pounds. I leave and bequeath to my grand
daughter Elizabeth Roche the sum of fifty pounds to be paid
to each of them on the day of their marriage or sooner if my
executors think proper but not to bear interest on the mean
time and if either of them shall marry without the consent
of my executors or two of them speech had in writing such of
them marrying without such consent shall receive the sum of
ten pounds only.
I leave and bequeath to my son Thomas aforesaid the sum of
three hundred pounds to discharge his notes due to my son
Charles for that amount. I leave and bequeath to my son
Homan the like amount of three hundred pounds both of which
sums to be paid them out of the portion of the business and
to which they have no further claim whatsoever and as to all
the residue and remainder of all such estate and property as
fitts good rights credits and shattles whatsoever where I
shall die seized passe (.....) of intitled to or inherested
in anywhere whatsoever. I leave demise and bequeath the same
and every part thereof to my two sons namely Humphrey Haines
of the City of Cork and my son Charles Haines of the town of
Mallow Junior share and share alike and to their several and
respective heirs administrators and assignees and I do
hereby nominate and appoint my Robert de la Cour of
Bearforest Esquire and my three sons Thomas Humphrey and
Charles Trustees and executors to this my last will and
testament - in witness whereby I the testator have hereto
subscribed my name and affixed my seal and published and
declared this my last will and testament and written by
myself the seventeenth day of June in the year one thousand
eight hundred and twenty five = Chas.Haines seal = signed

will and testament in the presence of us who in his presence
and at his desire and in presence of each other subscribed
