To the Reg^r app^d by act of Parl^t for Regist^g Deeds & Soforth. A Mem^l of an Ind^d Deed bear^g date the 2^d day of Dec^r 1818 & made Betⁿ Hugh Cumming of Kingswere St in the city of Dublin Public notary Exeor named & app^d in & by the last will and Testam^t of Benjⁿ Disrael form^y of Beechly Hill in the Co^y of Carlow Esq^r deceased & also residuary Devisee of the s^d Benjⁿ Disrael of the one part & Ja^s Eustace of Castlemore in the Co^y of Carlow Esq^r late a Major in his Majestys Roscommon Regt of Militia of the other part. Whereby after Recit^g that by Indented Deed bear^g date the 3^d day of Jan^y 1810 & made Betⁿ the s^d Ja^s Eustace of the first part the said Benjⁿ Disrael of the 2^d part & the s^d Hugh Cumming of the 3^d part the s^d Ja^s Eustace for & in conson of a sum of £2400 Stg to him paid by the s^d Benjⁿ Disrael did Grant Sell & Confirm unto the s^d Benjamin Disrael his heirs & ass^ns an ann^y of yearly rent Charge of £400 for & dur^g the natural life of the s^d Ja^s Eustace charged & Chargeable upon & issuing & payable out of all that & those the Towns & Lands of Castlemore, Corbally, Rathbally, Kenna, Ballyvohill, Tyneclash & Ballycurry oise Ballynecurry, Cloneen oise Clonnine, Kilknock, Tartane oise Tartan, the Mills of Bandens lame com^y called the Mills of Ballymurry, Glassgowan, Kilinaglish, One moiety of the Lands of Kilinaglish, Templeton oise Templepeter & Lisgarvan & a yearly fee from Rent of £137~2~6 issu^g out of the Towns & Lands of Augha All sit lying & being in the Co^y of Carlow payable ½ yearly as therein ment^d & also Recit^g that the s^d Ja^s Eustace for the more effectually secur^g the s^d ann^y did by the s^d Dec^d Grant & demise to the s^d Hugh Cumming his Exors Admors & ass^ns the sev^l Towns Lands fee farm Rent & prences so charged with the s^d Ann^y. To hold the s^d to the s^d Hugh Cumming his Exors Admors & ass^ns for the term of 99 years provided the s^d Ja^s Eustace sh^d so long live sub^t to redempⁿ as therein ment^d & also Recit^g the death of the s^d Benjⁿ Disrael & that the s^d Hugh Cumming as residuary Devise of the real freehold & personal property of the s^d Benjⁿ Disrael was Entitled to the s^d Annuity Granted by the s^d Ja^s Eustace as af^d & that the s^d Jas Eustace has agreed with the s^d Hugh Cumming for the redempⁿ or repurchase thereof the s^d Hugh Cumming for & in conson of the sum of £2400 Stg & all arrears of the s^d ann^y to him p^d by the s^d Ja^s Eustace did Grant Yield Up release & Surrender unto the s^d Ja^s Eustace his heirs & ass^ns all that & those the s^d herein before ment^d Ann^y or yearly rent charge of £400 so granted to the s^d Benjⁿ Disrael & Charges upon the afes^d Lands & Premes herein before ment^d. To Hold the same unto the s^d Ja^s Eustace his heirs & ass^ns for ever & did also Grant & assign & Sur^r to the s^d Ja^s Eustace All that & those the af^d Towns Lands fee farm rent and premes to him Granted & dem^d as af^d. To hold the same & every part thereof to the s^d Ja^s Eustace his heirs & ass^ns freed & disch^d from the trusts ment^d & deal^d in & by the said recited Indent of the 3^dday of Jan^y 1810 for & dur^g the rest residue & rem^r yet to come & [___] of the term of 99 years thereby granted as af^d which s^d Deed & this Mem^l are Witnessed by Dan^l Ryan & W^m Henry Crawford both of the City of Dublin Atte^y at Law.

Now David Ryan of the city of Dublin Gent. maketh oath & saith that he saw Hugh Cumming & Ja^s Eustace duly Execute the s^d Deed & the s^d Hugh Cumming duly Exete the above Mem^l thereof & dep^t saith the name David Ryan Sub^d as a witness to s^d Deed the above Mem^l is dep^ts Proper name & hand writ^g & saith he del^d s^d Deed & this Mem^l thereof to Oliver Moore Esq^r Dep^y Reg^r at the Reg^r Office on the Inns Quay Dublin in the 24 day of Dec^r 1818 at or about half past 12 of the clock noon of s^d Day. David Ryan Sworn before me this 24 day of Decr 1818. Ol^r Moore, Dep^y Reg^r.
