The Information which has been lodged with me against John Mirron of Kilcumney (£20) in the Parish of Balliellen, Michael Mcacey (£20) of Kilcumney in the Parish of Balliellen, William Mirron (£10) of Moneybeg [Bagenalstown] parish of Dunleckney, James Kelly (£10) of Moneybeg Parish of Dunleckney by Thady Malone, is for a rescue with force and violence against a Caption by - ? - Special Bailiff on a Civil procet [prosecution] Borris

Lemon or Lennon?

Difficult to make out if the surname on this document is Lemon or Lenon.

While it is not as clear as a previous document on which was recorded a Carlow Jeweller with the surname Lemon Mick Purcell thinks this may also be Lemon because of the "watchmaker" occupation.

Equally interesting is the occupation noted for George Bergan.

Recognizance to Prosecute.

County of Carlow to wit.

Joseph Lemon ( Lenon) of the Town and County of Carlow, Watchmaker, maketh oath that he usually Resides in the Town of Carlow.

Sworn before me this 28th Day of October 1816. 

Be it remembered that the above named Joesph Lemon came in his proper Person before me and Acknowledged himself to be Indebted unto our Sovereign Lord King George the Third, in the Sum of Ten Pounds Sterling. To appear in his proper Person in open Court to Prosecute George Bergan ( ? ) of Carlow, Bell Man and Town Crier of Carlow. (signed) Joseph Lemon. Taken and acknowledged before me the Day and Year aforesaid.

Names: Kelly, Troy, James & Lyons

A Rescue Recognizance was a "Rescue of Goods Distrained for Rent".

If the Constable, Bailiff or Sheriff seized goods or livestock for non-payment of Rent / Cess / Tax and if the seized goods were then taken back by force or other means then that was called "a rescue".

On the previous Statements we read that Pat Kelly, Matt Lyons, Richard Byrne have challenged the Constables Troy and James and have taken back the beasts that were seized.

The Informations as outlined on the Statements are making serious charges of "rescue" of cows and horse plus assault charges against Pat Kelly and Pat Lyons.

Patrick Kelly of Brake in the Townland of Drumphea, Carlow, Farmer, on the 15th Day of June in the fifty sixth Year of the Reign of our Sovereign Lord, George the Third, of the United Kingdom of Great Britain and Ireland, King, with force and arms, at Drumphea, Carlow in and upon one Paul Troy, Constable in the peace of God, and our said Lord the King, then and there being, did make an assault and one cow, one horse then and there did forcibly, unjustly and unlawfully take rescue of which before that time the said cow and horse were seized and distrained and in the custody of Paul Troy for rent arrears due to Robert Cornwall, Esquire, out of the lands of Drumphea.

Names: Rourke, Troy, Earl of Bessborough.

For Tobias Rourke of Drumphea, Carlow, Farmer, on the 27th Day of June in the fifty sixth Year of the Reign of our sovereign Lord, George the Third, of the United Kingdom of Great-Britain and Ireland, with force and arms, at Drumphea in the County of Carlow, in and upon one Paul Troy in the peace of God, and our said Lord the King, then and there being, did make an assault, and one cow, one heiffer and two horses, which had been before that time seized and distrained and in the Custody of Paul Troy for rent and arrears of rent due to the Right Honorable Earl of Bessborough out of the lands of Drumphea, from and out of the Custody of Paul Troy did then and there forcibly unjustly and unlawfully take and rescue.

[Note added 2012 - Paul Troy acting for his master the Earl of Bessborough has seized stock in lieu of rent arrears from Tobias Rourke. Tobias "rescued" the stock and is now charged before the Magistrates in Carlow for so doing.]

55th Year of the Reign of King George 111. ~ John McCann of Tullow in the County of Carlow, Yeoman, on the Sixteenth Day of October in the fifty fifth Year of the Reign of our Sovereign Lord George the Third, of the United Kingdom of Great-Britain and Ireland, King, at Tullow in the County of Carlow being a man of disloyal and seditious principles and intending to pervert the loyal subjects of our Lord the King from their duty and allegiance contemptuously, maliciously and seditiously by disaffected seditious speeches and arguments by him then and there uttered did obstruct and hinder the liege subjects of our said Lord the King from enlisting themselves as soldiers in his Majesties army in order to deprive his Majesty of the aid and assistance of his subjects against his enemies to the evil example of all others~~~

 James McCann found "Not Guilty"
