Sir,

The Enclosed Memorial, has been forwarded to me, from the Assistant Barrister for the Queens County, for whom I acted at the last Sessions Holden for that County. — The Prisoner John Carey, was tried before me, on a Charge of Larceny of a Pair of Boots.
It appeared in Evidence, that, he was, at the period of the Larceny, a domestic Servant, Residing in the House of his Master Doctor Bolton —That he disappeared — & Soon afterwards, the Articles, Specified in the Indictment, were found Missing — The Prisoner was traced to Dublin & there arrested, on Board a Steamer bound for

Liverpool & the Boots, found upon His person — The property was Clearly identified and the Jury without hesitation found him Guilty —He did not produce Any witness, nor did, on the trial, or afterwards, alledge, as he has now, done, that he had resorted to his masters Boots as a temporary Accomodation — And if he had, I apprehend the Jury would not have paid much attention, to the Statement —

Before passing Sentence I Enquired from the Crown Solicitors whether there were
 Any other Charges against

the Prisoner & I was informed, that there were Charges of obtaining Money under false Pretences;
 but none were the Subject of any indictment before me —
 The Prisoner got a character from his late Master, Doctor Bolton to the Effect, that, up to the period of the transaction in question, “he never Knew any thing against him”.
These are the facts of the Case; and in passing a Sentence of Transportation for Seven Years (with the Concurrance of the Magistrates present,) I acted upon a rule I had laid down & followed while discharging the duties of Recorder

of Londonderry, to visit with Exemplary punishment, the breach of Trust involved in theft

 Committed by Domestic Servants.

To His Excellency, The Right Honorable Earl of Besborough Lord Lieutenant General, and General Governor of Ireland.

The humble Petition of John Carey late of the town of Carlow and now a Prisoner under sentence of transportation in the Gaol of Maryboro, Most humbly Sheweth,

That your petitioner was tried at the last General Quarter Sessions of the Peace held at the Court House of Carlow, on the 15th instant for the Division of Graigue in the Queen’s County before – Boyde Esquire Deputy Assistant Barrister for said County for taking a pair of boots and was convicted, and sentenced to seven years transportation.

Your petitioner lived as servant with Doctor Bolton near the town of Carlow, in part of the Queen’s County. Petitioners shoes being very much broken, Petitioner unfortunately put on an old pair of his Master’s boots while petitioners shoes would be repairing, the Doctor observing the boots on petitioner swore examinations against him, who was then lodged in Gaol and suffered confinement for the space of two months before trial, Petitioner not being able to employ a Professional Gentleman and not thinking it a matter of great consequence made no defence and was convicted and sentenced as above stated.

Your petitioner is a very young man and heretofore supported an irreproachable character, Petitioner has never, before been impeached with the slightest misdemeanour, for the truth of which petitioner refers your Excellency to the

names of the highly respectable Gentleman and Clergy hereunto subscribed, Petitioner therefore earnestly but most respectfully hopes that your Excellency will be so good as to take petitioners case into your Excellency’s humane and charitable consideration and that your Excellency’s humane and charitable consideration and that your Excellency will be graciously pleased to order petitioners sentence to be commuted from Transportation to Imprisonment for any term your Excellency may deem prudent.
And petitioner as in duty bound will ever pray.
